What does "Wrongful Death" Mean?

Each state has their own definition and related laws regarding a Wrongful Death claim. However, it can be generalized as a family member seeking damages (compensation) for a death caused by a wrongful act, negligence, carelessness, or unskillfulness, such as:

There is a two-year statute of limitations for a Wrongful Death case in both Oklahoma and Texas. You do not have unlimited time to file and proceed with a claim. The sooner you file, the better. It is important to know that the case must be filed in the state where the death occurred. Who can file a Wrongful Death claim?

The state has the right to define those who may file a Wrongful Death claim. Generally, the surviving spouse, children, and parents of the deceased may bring action of benefit for all. An executor or administrator may also be able to pursue the case.
